Favorable Trial Verdict in New Orleans Federal Court
L&A Partner George Fagan successfully represented AIG Specialty Insurance Company as its lead trial counsel in a Declaratory Judgment action in a New Orleans federal court, with L&A Special Counsel Andrew C. Abrams serving as co-counsel. The case related to a December 19, 2022, state court judgment two former employees had won against UTC Laboratories, LLC, an insured company under an AIG Specialty policy.
Following the initial ruling in 2022, the defendants asserted a counterclaim against AIG Specialty seeking to collect the state court judgment reward, which awarded ~$3.225 million between both defendants, plus 6 years of accrued interest and other relief. Following a bench trial held in December 2023, District Judge Eldon E. Fallon issued Findings of Fact and Conclusions of Law dated January 26, 2024, in which he ruled that the AIG Specialty policy “does not provide coverage for the State Court judgment because the breach of contract exclusions contained in both the D&O and EPL Sections apply and judgment must be entered for AIG Specialty.”
After subsequently denying the defendants’ Motions for Reconsideration and/or New Trial, Judge Fallon entered a final judgment in favor of AIG Specialty and against the defendants on March 7, 2024.
